CRW Drone Policy

Purpose

The purpose of this policy is to support the activities of Clackamas River Water (CRW) District Unmanned Air Systems (UAS) operations. It is designed to govern the operations under the authority of CRW and the FAA.

Policy

It is the policy of CRW to utilize UAS to conduct district business including, but not limited to, reservoir and infrastructure assessments and the documentation of district property, assets, and/or activities.

Privacy Considerations

As a public institution, the UAS flight operations occur under federal authority as a public entity. CRW is responsible for compliance with all Federal State, and local laws as they pertain to privacy laws.

Personnel operating an UAS shall be mindful of privacy rights and shall not intentionally record or transmit images in any location where a person would have a reasonable expectation of privacy (e.g., inside house, fenced yard, enclosed area only visible from an elevated position).  Operators and observers will take reasonable precautions to avoid inadvertently recording or transmitting images in violation of privacy rights. 

Prohibited Uses

The UAS shall not be used for the following: 

  • To conduct random surveillance activities
  • To target a person based solely on individual characteristics, such as, but not limited to race, ethnicity, national origin, religion, disability, gender or sexual orientation
  • To harass, intimidate or discriminate against any individual or group
  • To conduct personal business of any type

Record Retention

Data, photographs, and video collected by the UAS shall be retained in accordance with Oregon State Records Retention Schedules. 

Disclosure

CRW adheres to all State and Feral statutes and regulations that prohibit information disclosure for students, employees, and other constituents. CRW will not sell, trade, or otherwise disclose any person’s identifiable information in any matter that is not in conformity with applicable State or Federal statutes. CRW takes appropriate steps to communicate all privacy policies and guidelines to all employees.

Freedom of Information

As a public entity CRW complies with the Freedom of Information Act, 5 U.S.C. §552, originally passed in 1966. Any information collected by UAS operations that fall under public domain will remain publicly accessible by request.
